Interrogation tactics Abstract The diploma thesis processes the topic of interrogation and tactics of its performance from the perspective of criminal law, criminology, and forensic psychology. The emphasis mainly lays on the first two perspectives. On the contrary, the psychology of interrogation is elaborated only in the extent of institutes and information, which are worked with in subsequent parts of the thesis, and which therefore had to be stated in general. The aim of the diploma thesis is to show the tactical procedures of interrogation in the account of legal norms, criminalistic and psychological recommendations. At the same time, emphasis lays on the comparison of Czech legislation with the French one with a focus on the regulation of interrogation tactics. The processed information was drawn from Czech and foreign monographs, expert essays, commentaries on specified laws, as well as French and internal case-law. The thesis is enriched of practical examples provided by the interrogator of the National Drug Headquarters and illustrative examples from records of interrogation. 87 Interrogation tactics ABSTRACT This thesis deals with interrogation tactics. The topic is still relevant as it is one of the most important and used criminal evidence. The aim of this work was to summarize available knowledge from Czech and foreign literature about conducting the interrogation, with a focus on the mistakes caused by interrogators. In addition to describing these mistakes, the work also recommends how to avoid them. Practical examples were obtained from available case-law and interrogation protocols. The analytical-descriptive and comparative method of research was used. The work is divided into five parts, introduction and conclusion. These parts are divided into individual chapters and subchapters. The first part is focused on the interrogation from the perspective of criminalistics, criminal law and forensic psychology. It defines the meaning and the purpose of interrogation and statement, different types and legal regulation. It also deals with psychological aspects of interrogation tactics. This paper deals with interrogation tactics. Using the descriptive-analytical and comparative methods, the aim of this thesis is to analyze the interviewing and the interrogation tactics in the Czech Republic. In some parts of my thesis, these tactics are compared with foreign approaches (particularly the United States and the United Kingdom). The work is continuously connected with the practice through examples from the real interrogation protocols. These interrogations which are in anonymous form anonymous form have been provided by the National Anti-Organized Crime Center and come from a five-year old investigation of an organized group that has committed, especially abroad, crimes against life and health. 76 Abstract: Interrogation tactics This thesis is focused on the interrogation management tactic, ie, in brief, how interrogator should conduct an interrogation to be both legal and successful. My aim in this work was to address the basic complexity of interrogation management and describe the basic procedures and techniques by which interrogator can obtain true testimony from the majority of interrogated groups. Due to the limited scope of this work, I could not incorporate specific areas of interrogation situations (questioning of juvenile, sick, etc.), so I focused mainly on interviews with the three main groups of people interrogated, which are interviews of people who can testify and want to, who want to, but can not and who do not want to testify, though they can, especially in situations where these persons are witnesses or subjects accused. In the first chapter of this thesis I deal with questioning from a general point of view of law, psychology and criminology, wherein most of the views and theories mentioned can be related to almost all specific interrogation situations. The purpose of my thesis is to explore and discuss interrogation tactics. Interrogation tactics is a concept that includes various methods used by interrogators to reach the goal of the interrogation, which is true and full testimony. Considering the extent of the topic, I am focusing more closely on the techniques used for the purpose of overcoming false testimony. The thesis is composed of nine chapters. In the opening chapters I explain the concept of interrogation from three perspectives - from the perspective of criminology, psychology and law. These chapters also describe different types of interrogation, as well as the process of documentation and the process of formation of testimony. The fifth chapter recognizes the issues of the preparation phase and its division into analytic and synthetic part. In this chapter I also emphasize the importance of expert and thorough preparation in order to ensure a successful interrogation. The sixth chapter presents three consecutive phases of interrogation, which are the initial phase and the phases of monologue and dialogue. 1 Die Kurzfassung Diese Diplomarbeit befasst sich mit der Taktik der Überwindung der erlogenen Aussage bei der Vernehmung. Sie konzertiert sich in diesem Kontext auf ein Paar Themen, die unmittelbar vernehmende sind. Besonders handelt es sich um die Vorbereitung und den Verlauf der Vernehmung. Die Diplomarbeit befasst sich auch mit den Personen, die die andere vernehmen, oder die vernehmen wird. Bei den vernehmenden Personen konzentriert sich die Diplomarbeit hauptsächlich auf die Beschuldigte und die Zeugen, bei denen ein hohes Risiko sein kann, dass sie mit einer potenziellen Motivation lügenhaft aussagen können. Das Ziel der Arbeit ist, den Querschnitt durch die bisherigen Erkenntnisse über die erlogene Aussage bei der Vernehmung zu machen. Besonders wenn es sich um die Indikatoren und die nachfolgende Methodik handelt, die eine Anleitung sein können, um eine erlogene Aussage bei den konkreten Typen der Menschen zu überwinden. Am Schluss der Arbeit wird es sich auch mit physischdetektiven Untersuchungen befasst. Ein Teil der Arbeit sind auch die Ergebnisse der gegenwärtigen polizeilichen Praxis.

Interrogation Tactics The aim of my diploma thesis is to provide an overview of methods of interrogation. The topic Interrogation Tactics is very broad, so I am especially focusing on the use of tactical procedures in a situation when the person is not willing to testify truthfully. The thesis is split into 5 key chapters, each of those attempts to summarize the most essential issues within the relevant field. The first part of this work outlines general aspects and also analyzes problems of examination and statement. This chapter introduces characteristics, definition and representation of interrogation and its legal background. Complete concept of the most common kinds of examinations are also described here. In order to satisfy the objective of examination, i.e. to get knowledge of relevant facts, thorough and accurate preparation is necessary. Otherwise the examination may not fulfill its task successfully. I focus on that in the second part of this thesis. In the third chapter called "Interrogation Tactics" I concentrate on the actual practice of interrogation tactics. Attention is paid to the general construction of questioning, i.e. its consecutive phases, and various individual situations that may occur during the interrogation are also discussed.
